Questions like those are why you should always take the 5th Amendment and refuse to answer any and all police questions.

You should always tell the police that you want them to honor your 6th Amendment right to consult to a lawyer, even if you don't have one.

And then when the cop violates your 6th Amendment right and starts questioning you take the 5th Amendment and refuse to answer any and all police questions.

One question cops asked drivers they stop in Arizona is:

On a scale of 1 to 10 how drunk are you, with 1 being the lowest level and 10 being the highest level?
The cop didn't tell you this, but this is a trick question and the only answer to the question is a big fat 0 or zero.

Of course the cop didn't give you the option of answering zero, because that would have gotten in his way of arresting you and convicting you of DUI or DWI.

A dumb person wanting to avoid a DUI or DWI ticket will foolishly answer the question with what they think is the right answer of 1.

Of course this is a trick question the police made up to help them arrest and convict people of DUI crimes.

If you answer 1, then unknowingly you have admitted to the cop that you are drunk and driving. And the cop will use that answer in your jury trial to convict you.

In Arizona DUI is considered to be driving with the slightest impairment, and admitting you are an itsy, bitsy, teeny weenie drunk with an answer of 1 is admitting you are drunk.

The smart person will simply take the 5th Amendment and refuse to answer any and all police questions.

Look folks I know you are not dumb and can sweet talk cops.

But cops shake down people 7 days a week, 24 hours a day and are experts at tricking people into answering questions that will guarantee they are convicted of crimes.

Another common question cops used to arrest people is getting them to admit that the stuff in their car or in their possession is marijuana.

Most people don't know that simple possession of marijuana is NOT a crime.

Yes, what I said is correct. Simple possession of marijuana is NOT a crime in Arizona.

In Arizona you have to KNOWINGLY possess marijuana to make it a crime.

So if you didn't KNOW that the marijuana in your car was there is it NOT a crime.

The law reads:

13-3405. Possession, use, production, sale or transportation of marijuana; classification

A. A person shall not KNOWINGLY:

1. Possess or use marijuana.

Of course cops will lie to you and give you a line of BS to get you to admit that YOU KNOW the stuff in your car is marijuana and then use that to get a conviction.

The cop will say something like.

Look it's just a small amount of marijuana, if you just admit it's marijuana I will drop everything and let you go.
And if you are dumb enough to believe the cops lie, as soon as you admit it's marijuana the cop will slap the handcuffs on and use your admission to convict you in court.

The police will tell you nothing but LIES to get you to answer their questions. You have to remember that they are nothing but LIES and you can't be punished, arrested or convicted for refusing to answer police questions.

Remember always demand that the police honor your 6th Amendment right to have a lawyer present during questioning.

And then when the cops violate your 6th Amendment right and start questioning you take the 5th to each and every question.
