CASS homeless shelter bans guns

CASS is breaking the law by not allowing homeless folks to check their guns????

Homeless folks can't check their guns at the CASS homeless shelter???

At a protest on Mill Avenue for gun rights and gay marriage rights I was talking to some people who said that CASS, which is a government shelter for homeless people doesn't allow homeless people with guns there.

Per Arizona law, if a government entity bans guns from their buildings or property they are required by law to allow the people to check their guns with the government agency for safe keeping.

I wrote this email to CASS and they seem to be violating the law by refusing to allow homeless people with guns to use their property.

Hi ******, Unfortunately we do not allow any firearms whatsoever on the entire campus and the best option would be to store it elsewhere.

If you are in need of emergency shelter and you are a single adult male just show up at 1214 W. Madison Ave. Phoenix Az. 85007 at around 5 p.m. 7 days a week and you will receive shelter at the MOS [Men's Overflow Shelter] which is open from 6 pm to 6 am 7 days a week. We only have 3 basic requirements to be able to access our shelter as we are not a rest bed facility.

1. You must be able to take care of your own basic needs i.e. Ability to get up and down from a bed under your own power and take care of your own basic hygiene needs. Please remember that CASS is not a rest bed facility.

2. You must not be a convicted Sex Offender and

3 The CASS Shelter is a drug and alcohol free program. I hope this answers your questions and Good Luck.

Thanks and Good Luck,

Shelter Manager

Guns on Valley Metro Buses

I beleive maybe 10, 15 years ago Valley Metro was hit with a lawsuit because they refused to allow bus passengers to carry guns on Phoenix area buses.

While Valley Metro has every right to ban guns on their buses they MUST per Arizona law allow passengers who have guns to check their guns with the bus driver.

Because having the bus driver check the guns of passengers who board Valley Metro buses I beleive that Valley Metro changed it's policy and now allows passengers to carry guns on Valley Metro buses and light rail trains.

I think it would be a great idea to sue CASS and get a court to order CASS to check the guns of any homeless people that need their services.

ARS 13-3102.01 - Requires guns to be checked

I think this is the law I am talking about which says if the government won't let you take your gun into a government building they must allow you to check your weapon.

ARS 13-3102.01

A. If an operator of a public establishment or a sponsor of a public event requests that a person carrying a deadly weapon remove the weapon, the operator or sponsor shall provide temporary and secure storage. The storage shall be readily accessible on entry into the establishment or event and allow for the immediate retrieval of the weapon on exit from the establishment or event.

B. This section does not apply to the licensed premises of any public establishment or public event with a license issued pursuant to title 4.

C. The operator of the establishment or the sponsor of the event or the employee of the operator or sponsor or the agent of the sponsor, including a public entity or public employee, is not liable for acts or omissions pursuant to this section unless the operator, sponsor, employee or agent intended to cause injury or was grossly negligent.

D. For the purposes of this section, "public establishment" and "public event" have the same meanings prescribed in section 13-3102.
